Processing and purposes NEBULA MEDICAL S.A.S. ("Nebula"), as Data Controller of the registration, contact, and billing data of its users, informs that the personal data you provide for your registration (which DO NOT include your clinical or health information) will be processed for the following purposes:
Provide the artificial intelligence software services for clinical documentation as contracted.
Manage the contractual or pre-contractual relationship between you and Nebula.
Perform analytics, processing, research, and statistical analysis activities to improve the services offered.
Send information about updates, new features, events, and news from Nebula, through authorized means.
Address inquiries, petitions, complaints, and claims.
Comply with applicable legal and regulatory obligations.
Patient clinical data (Nebula as Data Processor) Regarding the clinical data, health information, and sensitive data of patients that are entered, recorded, or processed through the platform, Nebula acts exclusively as a Data Processor.
It is the sole and exclusive responsibility of the healthcare professional or institution (acting as the Data Controller) to have obtained the prior, express, and informed authorization of the patient (Data Subject of the sensitive data) for the processing of their information through our assisted clinical documentation platform. Nebula will process this clinical data solely for the purpose of structuring clinical documentation and optimizing medical time, following the instructions of the Controller and the established technical and confidentiality limitations.
Nature of the service and medical responsibility Nebula is an assisted clinical documentation tool. The system structures and organizes the clinical information provided by the healthcare professional, without the capacity for diagnosis, prescription, or autonomous clinical decision-making. All content generated by the platform is for guidance purposes and must be verified, supplemented, and validated by the treating healthcare professional, who retains full autonomy and responsibility over clinical decisions, pursuant to Law 23 of 1981, Resolution 1995 of 1999, and applicable constitutional jurisprudence (Judgment T-323 of 2024).
Rights of the Data Subject As the Data Subject of your account/registration personal data, you have the right to know, update, rectify, and request the deletion of your data; request proof of the authorization granted; be informed about the use of your data; revoke authorization; and file complaints with the Superintendency of Industry and Commerce, after exhausting the procedure with Nebula. Patients wishing to exercise rights over their clinical data processed on the platform must direct their request to the treating healthcare professional (Data Controller).
